Oral arguments for Hot Creek appeal

The oral arguments for the Town of Mammoth Lakes’ Hot Creek appeal are being heard Monday, Oct. 18 in Sacramento. Town Manager Rob Clark as well as Town Attorney Peter Tracy are attending the hearing and the Town will be represented before the three-judge panel by special counsel Morrison and Foerster. Earlier this year Morrison and Foerster led the Town’s written briefing process. The process was also peer reviewed by two experienced attorneys who try cases before the appeals court.

According to the Town, the League of California Cities and the California State Association of Counties also filed a supporting brief that argued that the issues before the court are of statewide significance.

Mono County courts found in favor of Hot Creek in the 2008 litigation case. The verdict found that the Town of Mammoth had broken a development agreement with Hot Creek and therefore needed to pay the developer $30 million. The Town is now appealing this decision. –TOML/LAK
